Terms and Conditions
These Terms and Conditions govern access to and use of the website casemiri.com and the purchase of products offered by CASEMIRI SRLS.
By using the website or placing an order, you agree to these Terms and Conditions and to the other policies referred to on the website, including the Returns and Refunds Policy, Shipping Policy and Privacy Policy.
Our online store is hosted on the Shopify platform, which enables us to offer our products and services through the website.

2. Use of the Website
By using the website, you confirm that you have the legal capacity required to validly enter into a contract under applicable law.
You may not use the website, its content or the services offered for unlawful, fraudulent or unauthorised purposes, or otherwise in violation of applicable law or the rights of Casemiri or third parties.
You must also not transmit viruses, malware or other potentially harmful code, interfere with the proper operation of the website, attempt to gain unauthorised access to systems, or collect data or information through automated tools in violation of applicable law.
Casemiri reserves the right to restrict or suspend access to the website or related services in the event of unlawful or fraudulent use, or use that is contrary to these Terms, to the extent permitted by law.
3. Products
Casemiri endeavours to describe and represent its products as accurately as possible. However, the appearance of colours, shades and details may vary depending on the screen, device or settings used by the customer.
Product images are provided for illustrative purposes and do not affect the consumer’s rights where the product received does not conform to its description or stated characteristics.
Some Casemiri products are produced in limited quantities. Availability may therefore end at any time and restocking is not guaranteed.
Casemiri may modify the range, characteristics, availability and prices of products for future purchases. Such changes do not affect orders that have already been validly concluded.
4. Prices
The applicable prices are those displayed on the website at the time the order is placed, except in the event of obvious material errors.
The final price, any applicable taxes and shipping costs are displayed to the customer during the purchasing process and before the order is confirmed.
Casemiri may change product prices at any time. Price changes do not affect orders that have already been confirmed.
5. Orders
Submitting an order through the website constitutes a request to purchase the selected products.
After submitting your order, you will receive an electronic confirmation at the address provided during the purchase process.
Casemiri reserves the right, to the extent permitted by law, to refuse or cancel an order in circumstances including:
- product unavailability;
- an obvious error relating to the price or product information;
- payment authorisation issues;
- incomplete or manifestly incorrect shipping information;
- reasonable grounds to suspect fraudulent use of the website or payment methods;
- orders placed for unauthorised commercial resale purposes.
If an order that has already been paid for is cancelled by Casemiri, any amounts due will be refunded using the payment method originally used, unless otherwise agreed.
6. Information Provided by the Customer
The customer is responsible for ensuring that the information provided during the purchase process and, where applicable, within their account is accurate, complete and up to date.
In particular, please carefully check your name, delivery address, email address and contact details before confirming your order.
7. Payment Methods
Payments may be made using the methods available at checkout, which may include credit or debit cards accepted by Shopify Payments, Apple Pay, Google Pay, Klarna and any other payment methods made available.
The use of instalment or deferred payment services is subject to the approval and terms of the relevant provider. CASEMIRI SRLS is not responsible for decisions regarding credit approval, refusal or management made independently by such providers.
8. Shipping
Every Casemiri order is prepared in Italy and shipped directly from our Italian warehouse.
Casemiri ships to the destinations enabled on the website, including Italy, selected European Union countries, the United States and Australia.
Shipping costs, free-shipping thresholds, estimated delivery times and other conditions are specified in our Shipping Policy, which forms an integral part of these Terms and Conditions.
9. International Shipping, Duties and Importation
United States
Orders destined for the United States are shipped from Italy on a DDP (Delivered Duty Paid) basis. Any applicable duties and import charges relating to the shipment are handled by Casemiri and will not be charged to the customer by the courier upon delivery, as specified in our Shipping Policy.
Australia
Orders destined for Australia are subject to the tax and customs regulations applicable in the country. Any taxes, duties or other charges will be applied in accordance with the regulations in force at the time of purchase or importation. The DDP conditions applicable to the United States do not automatically apply to shipments destined for Australia.
Any procedures or inspections carried out by customs authorities may affect delivery times without this automatically constituting a breach attributable to Casemiri.
10. Order Cancellation
You may request cancellation of an order before shipment by contacting refunds@casemiri.com.
Whether an order can be cancelled depends on its preparation status. If the order has already been shipped or is at an advanced stage of preparation, it may be necessary to proceed in accordance with the applicable return conditions.
11. Right of Withdrawal - Italy and European Union
If you purchase as a consumer and your order is delivered in Italy or another European Union country, you have the right to withdraw from the contract within 14 days of receiving the product, without having to provide any reason, subject to the exceptions provided under applicable law.
Withdrawal may be communicated through the withdrawal function available on our website or through the additional methods specified in our Returns and Refunds Policy.
The procedures, time limits, return of products, any reduction in value and refund procedures are governed by our Returns and Refunds Policy.
12. Returns from the United States and Australia
For orders delivered to the United States or Australia, Casemiri voluntarily offers customers the possibility to request a return within 14 days of receiving the product, subject to the conditions set out in our Returns and Refunds Policy.
Where a return is made due to a simple change of mind, return shipping from the United States or Australia must be arranged and paid for by the customer.
Before returning the goods, the customer must contact Casemiri and follow the instructions provided, including those relating to the correct customs declaration of returned goods.
This commercial return policy does not limit any mandatory rights granted to the customer under applicable law.
13. Legal Guarantee and Non-Conforming Products
Products sold by Casemiri are covered by the legal guarantee of conformity and any other mandatory rights granted to consumers under applicable law.
If the product received is defective, damaged, does not conform to the description or differs from what was ordered, please contact refunds@casemiri.com.
Casemiri will assess the request and provide the remedies required under applicable law, without limiting any mandatory rights granted to the consumer.
For purchases made by consumers in Australia, all rights and remedies provided under the Australian Consumer Law, including applicable consumer guarantees, remain expressly unaffected.
14. Refunds
Refund procedures and timeframes are governed by our Returns and Refunds Policy.
Refunds are generally issued using the same payment method used for the purchase, unless otherwise agreed or otherwise required under applicable law.
15. Third-Party Tools and Services
The website may provide access to services, tools or features supplied by third parties.
The use of such services may be subject to the terms, conditions and policies of the relevant provider. Casemiri does not control services independently operated by third parties and is not responsible for their operation to the extent that this is not attributable to Casemiri, without prejudice to any mandatory rights provided by law.

If you voluntarily submit comments, suggestions, feedback, ideas or other contributions to Casemiri, you warrant that you have the right to submit them and that their content does not infringe the rights of third parties or applicable law.
You may not submit unlawful, defamatory, offensive or fraudulent content, content that infringes the rights of third parties, or content containing harmful software.
The use by Casemiri of content specifically created or licensed by users, creators or collaborators may be governed by separate agreements.
18. Intellectual Property
The content available on the website, including but not limited to text, photographs, images, graphics, logos, trademarks, visual elements, videos, designs and editorial materials, is protected by applicable intellectual and industrial property laws.

If an obvious error affects an order that has already been placed, Casemiri will contact the customer and manage the order in accordance with applicable law, including, where necessary, cancellation and refund of any amounts paid.

Casemiri endeavours to keep the website and services accessible and operational but cannot guarantee that they will always be free from interruptions, technical errors or temporary unavailability caused, for example, by maintenance, updates, network failures, third-party service interruptions or circumstances beyond its control.
To the fullest extent permitted by applicable law, Casemiri will not be liable for indirect or consequential damages that are not reasonably foreseeable or directly attributable to a breach of its obligations.
Nothing in these Terms and Conditions excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, nor does it limit any mandatory rights granted to consumers.
22. Severability
If any provision of these Terms and Conditions is declared invalid, ineffective or unenforceable, that provision will be considered severable to the extent necessary and the remaining provisions will continue to have effect, to the extent permitted by law.
23. Entire Agreement
These Terms and Conditions, together with the policies and conditions referred to on the website and applicable to the purchase, govern the relationship between the customer and Casemiri in relation to the use of the website and orders placed through it.
Casemiri’s failure to exercise any right under these Terms does not constitute a waiver of that right.
24. Governing Law and Disputes
These Terms and Conditions are governed by and construed in accordance with Italian law, without prejudice to the consumer’s right to benefit from any mandatory protections provided under the law of their country of habitual residence, where applicable.
Where the customer acts as a consumer, any mandatory rules concerning jurisdiction and consumer protection also remain unaffected.
25. Changes to the Terms and Conditions
Casemiri may update these Terms and Conditions by publishing a new version on the website.
Changes apply to use of the website and purchases made after they come into effect and do not affect rights already acquired in relation to orders previously concluded.
